Terms & Privacy

1. Agreement

By accessing kage-ai.io or using any kage service, you agree to these terms. kage is operated by kage-ai.io ("we", "us", "kage"). If you do not agree, do not use the service.

2. What kage provides

kage is an autonomous content operations service. We research, draft, and route content on behalf of clients using AI. The service includes daily briefings, on-demand drafting, trend monitoring, outreach drafts, publishing support, and performance reporting. Exact features depend on your tier.

3. Client responsibilities

• You are responsible for reviewing and approving all content before it is published.
• You must ensure content published through kage complies with applicable laws and platform rules.
• You own all content you provide to kage and all approved content kage produces for you.
• You must not use kage to produce content that is false, defamatory, or harmful.

4. Setup fee and billing

A one-time setup fee of $2,500 is required before onboarding begins. Monthly retainer fees are billed in advance. All fees are non-refundable once setup has commenced or the billing period has begun. We reserve the right to suspend service for non-payment after 7 days notice.

5. Intellectual property

You retain ownership of all content approved and published through kage. We retain ownership of the kage platform, systems, voice skill methodology, and knowledge graph infrastructure. We may reference your use of kage in marketing materials unless you request otherwise in writing.

6. Confidentiality

We treat all client information (brand guidelines, posts, audience details, business context) as confidential. We do not share your data with third parties except as required to operate the service (e.g. Anthropic's Claude API and OpenAI's API for AI processing and web research, Supabase for data storage, Hetzner for hosting). See our Privacy Policy for full details.

7. AI-generated content

kage generates content with Anthropic's Claude or OpenAI's models, whichever your profile has chosen, and uses the other as a backup when the first is unavailable. We do not guarantee that AI-generated content is accurate, original, or free from errors. You are responsible for reviewing all content before publication. We are not liable for any consequences arising from published content.

8. Service availability

We aim to maintain continuous service but do not guarantee uptime. Scheduled maintenance, third-party outages (AI providers, Hetzner, Signal), or unforeseen technical issues may cause interruptions. We will notify clients of planned downtime where possible.

9. Termination

Either party may terminate the service with 30 days written notice. We may terminate immediately for breach of these terms. Upon termination, we will provide you with your voice skill files and knowledge base. Monthly fees are not refunded for partial months.

10. Limitation of liability

kage is not liable for any indirect, incidental, or consequential damages arising from use of the service. Our total liability is limited to the fees paid in the 30 days preceding the claim. Nothing in these terms limits liability for fraud or death caused by negligence.

11. Governing law

These terms are governed by the laws of Spain. Disputes will be resolved in the courts of Madrid.

1. Who we are

kage-ai.io operates the kage autonomous content operations service. We are the data controller for information collected through kage-ai.io and our client portal.

2. What data we collect

• Account data: email address and password (stored securely via Supabase Auth)
• Onboarding data: posts, brand guidelines, audience details, competitor lists, tool preferences, and any other information you provide through the client portal
• Usage data: how you interact with the portal and dashboard
• Content data: drafts, briefings, and approved posts produced by kage on your behalf
• Communication data: messages exchanged with kage via Signal, WhatsApp, Telegram, or Discord

3. How we use your data

• To build and maintain your voice skill and knowledge layer
• To generate and route content drafts on your behalf
• To monitor your industry and produce daily briefings
• To improve the kage service and your agent's performance over time
• To communicate with you about your account and service updates

4. Third-party services

We use the following third-party services to operate kage:

• Anthropic Claude: AI processing and web research for profiles that choose Claude, and backup processing for profiles that choose OpenAI. Your data is sent to Claude's API only for those requests. Anthropic's privacy policy applies.
• OpenAI: AI processing and web research for profiles that choose OpenAI, and backup processing for profiles that choose Claude. Your data is sent to OpenAI's API only for those requests. OpenAI's privacy policy applies, and OpenAI does not train on API data by default.
• Web research: to research a draft, kage sends the topic, your business context and your recent posts to the AI provider your profile has chosen, which runs the web searches. The websites it reads receive the provider's search and page requests, not your files or your voice profile.
• Supabase: database and authentication. Your account and onboarding data is stored on Supabase's infrastructure.
• Hetzner: server hosting in the United States (Oregon). Your agent runs on Hetzner servers.
• Signal, WhatsApp, Telegram, Discord: messaging delivery. Your chosen messaging platform receives briefings and drafts.

5. The kage connector

You can connect kage to third-party AI applications, such as Claude, Claude Desktop, Claude Code, and Cursor, through our Model Context Protocol connector at mcp.kage-ai.io. This section explains what happens to your data when you do.

• How access is granted: you sign in with your kage account and approve each application yourself. Access covers your own client account, or every client under your agency if you are an owner or admin of that agency. Applications receive access tokens that expire after one hour and refresh tokens that expire after 30 days, and tokens issued through sign-in are stored only in hashed form.
• What a connected application can read: your voice profile, your recent posts and their performance notes, and the topics you track.
• What a connected application can send to kage: briefs, drafts saved to your approval queue, and edits you report, which we use to keep refining your voice model. Nothing publishes without your approval inside kage.
• What we receive: the name and redirect address the application registers with, and a record of each request, including the time and the kage tool it called. We do not receive your conversations with the application, only the content it sends to kage tools.
• Drafting through the connector: when an application asks kage to write, your voice profile and the brief are sent to the AI provider your profile has chosen, Anthropic or OpenAI, or to the other if the first is unavailable, to generate the copy, as described in section 4.
• Content returned to the application: once kage returns your voice profile, context, or a draft to a connected application, that application handles it under its own terms and privacy policy. For Claude, Anthropic's privacy policy applies.
• Removing access: you can disconnect an application from within it at any time, and you can email us to revoke its tokens immediately. Access also ends when your kage account is closed.

6. Data retention

We retain your data for as long as your account is active. If you cancel, we retain your data for 90 days to allow for reactivation, then delete it permanently. You can request immediate deletion by emailing us.

7. Your rights

Under GDPR and applicable privacy law, you have the right to access, correct, export, or delete your personal data at any time. You can exercise these rights by emailing us. We will respond within 30 days.

8. Data security

We use industry-standard security measures including encrypted connections (HTTPS/SSL), Supabase row-level security, and restricted server access. No system is completely secure. We cannot guarantee absolute security but take reasonable steps to protect your data.

9. Cookies

kage-ai.io uses only essential cookies required for authentication (Supabase session tokens). We do not use tracking or advertising cookies.

10. Changes to this policy

We may update this policy as the service evolves. We will notify active clients of material changes by email. Continued use of the service after changes constitutes acceptance.
